IZZY REYES TO RETIRE NEXT MONTH

But we already said that, and you already knew it.

What are the ramifications of a good, honest, dedicated jurist leaving the bench because Governor Scott's attempt to balance the budget on the backs of public servants?
Well, in this instance, we lose an excellent and experienced judge.
Who will replace him?

DOM posted a link to a wild federal order out of Texas that starts "Progress May have been alright once, but it has gone on too long." The wacky opinion is here.

The NFL Lockout was ended by Judicial Fiat, but for how long?

Here's what we don't get about the Libya thing: We can drop bombs on soldiers and their generals all day long, but if one American per chance has Qadiffi in his or her gun sights, they cannot legally pull the trigger.

Also this: If Qadaffi buys it, what other words are there that start with a Q but don't have a U?

Some reporter from the DBR is sniffing around the lot 26 story. He wants a lawyer to get beat up....we mean arrested, and then interview them. Any volunteers?

Really, we got nothing today.

The Captain Reports:

Judge Israel "Izzy" Reyes is in Group 65 of the Circuit Court. His seat was up for re-election in 2012. He could have served until December 31, 2012.

With his resignation, Governor Scott will appoint his replacement.

WHILE YOU WERE SLEEPING .....

While many of you were deep into REM, a closed door meeting was taking place in the panhandle down the road from where the Seminoles play.

The Senate, which did not have a bill that would redesign the Florida Supreme Court ala FDR's court packing plan, made a deal with the House, which did, and that trade off was one of the pieces of the puzzle that resulted in a budget agreement between the two chambers.

So, now, we can look forward to significant change in our court system; some of it in bills that will pass in the next week - other changes would have to be approved by the voters in a constitutional amendment.

The Supreme Court could go from seven to ten members, with two chambers of five - one handling only criminal matters. Of course, Gov. Scott would be able to add the three new justices, as well as name the CJ of each chamber.

The JNC's could also go through a drastic change. All terms of every JNC member would end immediately, so that Scott can name all members. The terms of the new members would coincide with the term of the Governor, so that every new Governor can appoint all new slates.

All this going on while KFR and CM are fighting for the lives of their offices and their employees. A budget plan being thrown back and forth, if approved, would change the formula for how much each SA & PD office gets, redistributing the money out of the 11th Circuit, and giving the money instead to offices in SW Florida and Central and North Central Florida.

Much more change to come in the way of salary reductions, pension contributions, rule making, etc. With just over one week left in the legislative session, be prepared for a whole new "justice" system after July 1, 2011.

Oh yeah, Rump, now may be a good time to take the first word out of the name of your blog - just call it the "Building Blog".

Rump - you are technically wrong in your conclusion that it would be illegal for a U.S. soldier to kill Gaddafi as a result of the Presidential executive order previously signed which prohibits assassination of foreign leaders. The reason why U.S. forces may kill Gaddafi in this conflict is that the CIA and DofD have already determined that he is a "Colonel" in the Libyan Defense Force and is an "active soldier". Hence, our NATO battle plan includes his elimination and regime change - with no violation of the Geneva Convention or executive orders.

Izzy will be miserable in private practice, especially if he goes to some firm which makes him bill 2300 hours per year. All those years at the SAO and then on the bench. He's never really had to answer to anyone and now he has to deal with billable hours. Ugh.

The Shumie was called at 1:09 PM.
There was a challenege at 1:50 pm "premature shumie-(there's a new medicine for that, bit I digress) )

After further review, the shumie was called way too early for a Wednesday. !;50 pm can leave work ten minites early for a successful challenege and 1:09 has to stay thirty minutes later.

You smucks, up here in Florida, we have been boosting our trial numbers. PDs and State Attorneys have been pushing cases to jury trial and we have been lobbying to base the funding on the number of trials. Measure trials and fund accordingly, it is a better and more accurate way to see who is busy and needs $$$$


God, I love it when a plan comes together. Our trial numbers are way up. Orange, Hillsbourgh, Brevard, everybody knows the plan but Dade, Broward and Palm Beach. We win, you lose.
